Welcome to KSM Exhibits (“we,” “us,” “our”). These Terms govern your use of https://ksmexhibits.com (the “Site”). If you do not agree, please do not use the Site.
We do not sell products or take payments on the Site. Any design, fabrication, rental, or show services you purchase from us are governed by a separate written quote/estimate, statement of work (SOW), rental agreement, or contract. If those conflict with these Terms, the SOW/contract controls for that project.

2) Acceptable use
You agree not to misuse the Site (e.g., no scraping, framing, reverse-engineering, probing security, spamming, or unlawful activity). We may change, suspend, or remove the Site at any time.
3) Intellectual property, brand use, and portfolio materials
- Site content. All content on the Site—including text, photos, 3D renders, graphics, videos, case studies, and page layouts—is owned by us or our licensors and protected by law. Except as allowed by law, you may not copy, reproduce, adapt, distribute, publicly display, or create derivative works without our written permission.
- Limited license. We grant you a limited, revocable, non-transferable license to access and view the Site for personal or internal business purposes only.
- Trademarks & brand assets. Our names, logos, icons, and trade dress—including without limitation KSM Exhibits, the KSM word mark, and associated graphics (collectively, the “Marks”)—are our property. You may not use the Marks (including in titles, meta tags, ads, or URLs) without our prior written consent, and no affiliation, sponsorship, or endorsement is implied by any third-party references on the Site.
- Client logos on the Site. Logos and brand names of our clients shown on the Site belong to their respective owners and are used for identification/portfolio purposes only. Their appearance does not imply endorsement.
- Portfolio use & removals. We showcase photos/renders of projects we’ve produced. We respect confidentiality: if a project is subject to an NDA or you are a rights holder who prefers a specific image or logo not be displayed, email info@ksmexhibits.com with the URL and details. We will review and, where appropriate, remove or revise promptly.
4) Third-party links & services
The Site may link to third-party websites or services. We don’t control them and aren’t responsible for their content, policies, or actions. Use them at your own risk.
4A) Linking to our Site
You may link to our homepage if you do so in a way that is fair and lawful and does not damage our reputation or take advantage of it. You must not:
- suggest any form of affiliation, approval, or endorsement by us where none exists;
- use our names, logos, or trade dress without written permission;
- frame or mirror any part of the Site, or hotlink our images, videos, or files; or
- place the link on a site that is unlawful or infringes third-party rights.
We may withdraw linking permission at any time. If we ask you to remove a link to the Site, you will do so promptly.
5) Privacy
We handle personal information as described in our Privacy Policy. Where required, regional choices (e.g., cookie preferences or data-sharing opt-out) are available via our banner or footer links.
6) Disclaimers
The Site is provided “as is” and “as available.” We make no warranties—express or implied—including merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted or error-free.
7) Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue, related to your use of the Site. Our total liability related to the Site will not exceed USD $1,000.
8) Governing law & venue
These Terms are governed by the laws of the State of California. You agree to the exclusive jurisdiction of the state or federal courts located in Orange County, California for any dispute relating to the Site.
8A) Dispute resolution (individual arbitration + small-claims carve-out)
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. The seat and venue of arbitration will be Orange County, California, and the language will be English. The arbitrator may award individual relief permitted by law.
- Small-claims exception. Either party may bring an eligible claim in small-claims court in Orange County, California instead of arbitration.
- Injunctive relief. Either party may seek temporary or injunctive relief in a court in Orange County, California to protect intellectual-property or confidential-information rights.
- No class actions. Class, collective, representative, or private-attorney-general actions are not permitted, and the arbitrator may award relief only to the individual party.
- Costs. Arbitration fees will be allocated under the JAMS consumer rules; if required by those rules, we will pay the portion of fees necessary to ensure the arbitration is not cost-prohibitive.
- 30-day opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@ksmexhibits.com with the subject “Arbitration opt-out” and your name and the URL of the page where you accepted.
If a court finds the class-action waiver unenforceable, this arbitration section is severed and disputes will be heard in the courts specified in Section 8.
9) Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Changes take effect when posted and apply going forward.
